Could a ruling today throw out charges and let Lindsay Clancy walk free?

Judge considers next steps

Clancy, 36, faces first-degree murder charges over the 2023 deaths of her children, Cora, Dawson and Callan. Monday’s hearing is set to address her request to dismiss the case and the timetable for any retrial.

Her defence says a second trial would violate protections against double jeopardy. Lawyers have also argued that the mistrial declared on September 4 was unnecessary and that a juror should have been questioned. Prosecutors urged Judge Sullivan to reject the dismissal request.

First trial ended without verdict

The trial ended in a mistrial after jurors could not agree on a verdict. One juror, Michael Desronvil, later told Fox News Channel that he believed Clancy was guilty and was influenced by what he considered her methodical actions.

Retrial options remain open

Prosecutors could pursue first-degree murder charges again or seek second-degree charges, which would permit a bench trial. They have not yet decided whether to bring the case before another jury.

Clancy, a former labor and delivery nurse, is expected to remain at a psychiatric hospital until the case is resolved. The proceedings have attracted public attention to maternal mental health after childbirth.

Key points

  • A judge will consider whether the murder charges can proceed and discuss any retrial schedule.
  • Clancy’s defence argues double jeopardy bars a second trial after the jury deadlocked.
  • Prosecutors oppose dismissing the case but have not chosen whether to seek another jury trial.
