Maurene Comey Wins Court Ruling Over Her Firing as Prosecutor; James Comey’s Daughter Was Dismissed Without Cause

Judge rules firing unlawful

Judge Furman ruled Monday that the Justice Department violated the Civil Service Reform Act when it fired Maurene Comey. The 1978 law provides protections for federal workers. Furman wrote that the Trump administration was seeking to “upend” established case law on Congress’s authority to regulate the removal of certain federal officers. He found the court could hear Comey’s case because her firing relied on Article II of the Constitution rather than a federal civil-service law.

Comey’s prosecution record

Comey had worked as a federal prosecutor in Manhattan since 2015. Her cases included those involving Sean “Diddy” Combs, Jeffrey Epstein, Ghislaine Maxwell and former Democratic Sen. Robert Menendez.

In a letter to former colleagues, Comey said Justice Department headquarters had dismissed her by memo without explaining why. She described the action as a summary firing.

Administration’s defense challenged

The Trump administration later said then-Attorney General Pam Bondi had directed Comey’s removal, while her successor, Todd Blanche, ratified the termination. It was initially unclear who had made the decision.

Comey’s attorneys argued in their complaint that firing her without cause, advance notice or an opportunity to challenge the decision was unlawful and unconstitutional. The administration also cited a Supreme Court decision from June that allowed the president to dismiss members of certain independent agencies without cause.

Broader fight over authority

The Supreme Court ruling cited by the administration overturned a decision more than 90 years old. That earlier ruling had allowed Congress to limit the president’s power to remove officials from multimember agencies at will.

Comey’s lawsuit is one of several filed by former government employees dismissed without cause. The cases raise questions about the boundaries of presidential power to fire federal officials.
